SUCCESSION

Transfer of inheritance is subject to the provisions of Chapter Three of the Family Code. The foundations for the hereditary claim are kinship and the status of the husband (see Law No. 84 of June 11, 1984 relating to the Family Code, amended and supplemented)

In this context, the social interest in charge of implementing the procedures related to the study of inheritance transfer as well as preserving the social rights of the heirs (death grant, survivors’ pension, widow’s pension).

Certificate of inheritance or obligatory “issued by the notary in Algeria. It means the heirs of the deceased and the share of each heir. This document is necessary in dividing the transfer of inheritance.

The file must include the following documents:

- Original death certificate in Spanish for deceased citizens within the consular district.

The original inheritance document in Arabic written before a notary in Algeria, accompanied by a translation into Spanish.

- a notarized power of attorney signed by all the heirs, to appoint an agent to recover the property once it has been transferred to Algeria, accompanied by its translation;

- Bank statement (RIB) of a foreign currency account opened in the name of the agent in a bank in Algeria or abroad;

- Delegation of powers (available at the social service level) duly completed and signed by the agent and stamped by the municipal council of the residence.

Transfer of assets in the course of inheritance:

According to Article 213 of the Customs Code, property inherited (furniture and personal effects, including a car) by an Algerian citizen who died in the country of residence can be imported by his family into Algeria without foreign trade formalities. Exemption from fees and taxes.

the required conditions:

The entire property inherited must be of the deceased prior to his death.

These assets are returned once within one year from the date of the "obligatory".

Only a duly authorized person can take the necessary actions.

Customs is completed when the file containing the following documents is submitted:

Vehicle registration document in addition to the invoice (if any).

A customs declaration on the date of the first run.

A certified copy of the obligatory prayer certificate
